Numerous Cases of Illegal Adoption of Children by Foreigners Detected

The National Security Service of RA, staying focused on children's rights-envisaged by the international treaties and the internal laws of RA- as well as staying focused on the issue of protecting the legal rights of parents and the state with regard to adoption and family protection, as a result of large-scale operative-search measures and investigative activities undertaken within the functions vested on it by the law, detected cases of adoption of numerous children by foreigners with a gross violation of the laws of the Republic of Armenia.
According to the obtained factual information, 2 citizens of the Republic of Armenia, using their contacts in one of the republican obstetrical institutions, in a number of agencies in the Republic of Armenia, as well as in orphanages, with a gross violation of the laws of the Republic of Armenia organized the adoption of more than three dozen children (citizens of the Republic of Armenia) by the citizens of the Italian Republic, who had taken custody of these children.
For this reason, a number of officers of the obstetrical institution, who had regulatory and other management functions, according to prior agreement, with a direct intent for mercenary motives, within the period of 2016-2018 prompted more than a dozen women, who applied to the company’s maternity hospital to terminate the pregnancy for social or personal reasons, to give up the child for adoption and to give consent for adoption against their will - moreover in some cases by threatening to unveil the fact of pregnancy, by exaggerating the newborn's health problem and by using psychological pressure with false information; besides, in several instances they didn’t even avoid taking money from maternity patients as a bribe for the provided medical services. After receiving a written consent the majority of newborns were taken to orphanages along with medical documents. The officials of the mentioned institutions, abusing official powers and using made-up diagnoses mentioned in the documents by the maternity hospital, violated the priority of Armenian citizens’ right to adopt these children, thus indirectly preventing these children's adoption by the citizens of the Republic of Armenia.
According to the corresponding articles of the Criminal Code of RA, a criminal case has been initiated in the Investigation Department of RA NSS on the fact of the apparent crimes. Preliminary investigation goes on.
Note: The suspect or accused of an alleged crime is considered innocent as long as his guilt is not proven in a manner prescribed by the Code of Criminal Procedure of RA - by the court decision entered into legal force.
