As a result of operative-search measures undertaken by the RA National Security Service, factual data were obtained that the official who held the position of the head of the Arabkir administrative district of Yerevan during 2005-2008, based on group interests, by committing official falsifications, fraudulently acquired the right to the property of the community in especially large amounts, and also, with the prior consent of the members of the Council of Elders, alienated a number of real estate objects on the balance sheet of the community, through formal auctions or direct sale, at prices incomparably lower than the market and cadastral value, to various citizens, as a result of which the community suffered damage in especially large amounts in the amount of 300.000.000 AMD.
In particular, the competent official of the Arabkir administrative district of Yerevan, for mercenary motives to acquire the right of ownership of property in especially large quantities belonging to the community, by prior agreement with the members of the Council of Elders of the community and influencing the latter, by persuasion, induced them by an appropriate decision to permit the alienation of community property at a price incomparably low than the cadastral value. As a result, in August 2006, by the decision of the Council of Elders of the Arabkir regional community, the alienation by fictitious auction of apartment No. 60, house 3, on Mamikonyants Street in Yerevan, with an area of 79 square meters, was permitted, setting the starting price at 3.350.000 AMD, the cadastral value of which at that time was 5.492.500 AMD. Then the same officials, taking advantage of the opportunity provided by the decision of the Council of Elders, organized a fictitious competition regarding its alienation from this auction, during which the mentioned real estate was allegedly alienated to A. Gh. at the starting price, and forged official documents were drawn up and put into circulation. During the fictitious auction, which took place on August 31, 2006, the mentioned real estate was alienated at the starting price to A. Gh., who in fact did not participate in the auction. Then, in October 2006, a forged power of attorney was drawn up and put into circulation in the same manner, on the basis of which the mentioned apartment was sold for 14.440.000 AMD to S. H., who in November of the same year alienated the apartment to E. P. under a mortgage and real estate purchase and sale agreement for 16.361.930 AMD. Thus, the latter acquired the right of ownership of property in especially large quantities belonging to the community.
At the same time, factual data were obtained that by the decision of the Council of Elders of the Arabkir administrative district dated March 26, 2007, the alienation of a land plot of 16.687 square meters was permitted, located at Tbilisyan 3/3, provided free of charge for use by the office of the head of the Arabkir district community for the purpose of carrying out sanitary cleaning and garbage removal works, during which authorized officials, ignoring the fact that the alienated real estate was not fully assessed, abusing their official powers, based on mercenary motives of acquiring community property at a significantly lower price, drew up and put into circulation a protocol, completely false in content, drawn up by the property alienation commission, regarding the fact that the property was assessed (the market value was indicated much lower – 29.800.000 AMD). As a result, on the mentioned land plot located at Tbilisyan 3/3, in the form of direct sale of a building-structure with an area of 2734.6 square meters were alienated by E. Sh. to a close relative, who is the father of the competent official of the Arabkir administrative district of Yerevan for 29.800.000 AMD (the cadastral value of the buildings and structures amounted to 38.220.700 AMD), who, having paid the cadastral value of the land plot, became its owner, then, having divided the acquired property into 2 property units, sold them for 91.800.000 AMD and 340.000.000 AMD, respectively.
At the same time, factual data were obtained that there were other cases of alienation of land plots and property belonging to the community by the competent official of the Arabkir administrative district of Yerevan at a price significantly lower than the cadastral value by applying a corruption mechanism, based on selfish motives, as a result of which the Yerevan community was deprived of a real opportunity to receive an especially large income of 300.000.000 AMD in exchange for the alienation of property that was its property, which caused significant property damage to the legitimate interests of the Yerevan community, causing serious consequences.
Thus, as a result of the officials using their official position against the interests of the Service, serious consequences arose through negligence: the authorities were deprived of authority, the community suffered property damage in especially large amounts, the principle of equality and fairness during the auction was violated, the rights and legitimate interests of other participants were violated.
In connection with the incident, a criminal case was initiated in the Investigative Department of the RA NSS on the grounds of the relevant articles of the RA Criminal Code.
Using the permitted criminal procedural toolkit, the necessary investigative and other procedural actions are being taken to clarify all the circumstances of the case, the full circle of persons who committed the crime, and restore the legitimate interests of the community.
Note: the suspect or accused of an alleged crime is considered innocent as long as his/her guilt is not proven in a manner prescribed by the Code of Criminal Procedure of RA - by the court decision entered into legal force.
